Hi,
Rasmus Skjoldan has officially released the new logo and guidelines for the usage of the logo. The logo and the guidelines are provided under the creative commons license. This entails that you must attribute the TYPO3 Association when using the logo.
The new logo should not used before the 29th of January 2006. The first day of the T3BOARD next year. This is the date where the official new CI is presented to the public.

They are using the "old" BETA version of the logo. When that version was released there where no restrictions for using it.
